Business Interruption and Liability Insurance Coverage in Response to COVID-19

We do not presently know the nature and extent of claims that may be brought forth in the future, directly or indirectly, resulting from this Pandemic. Unfortunately, there is not one simple or specific answer to such broad and complex questions.

The generic answer at this time is that there are specialty and very unique products in the market for specific industries, but standard Business Interruption Insurance for Commercial and Farm operations is triggered as a result of physical loss or damage suffered to the insured premises that is caused by a peril covered by the underlying Property Insurance policy.

That means, Business Interruption due to closure, either by Public Authorities, or voluntary, supply chain distribution, contingent losses, lack of market, contamination or illness, are not perils insured under a contract of Business Interruption Insurance.

The Commercial General Liability policy, and the Personal and Premises Liability policies provide an obligation to defend and indemnify the insured for claims of bodily injury or property damages based on negligence. The obligation to defend may be a separate and distinct obligation from that to indemnify.
